WILL OF RIPLEY COPELAND

 

STATE OF SOUTH CAROLINA,

SUMTER DISTRICT

 

IN THE NAME OF GOD, AMEN.

 

I, Ripley Copeland, Sen'r. of State and District aforesaid, being feeble in body but of sound mind and memory, blessed be God for same, but calling to mind the mortality of my body, and knowing it is appointed for all men once to die, do make and ordain this my last Will and Testament. Principally, and first of all, I resign my soul to God who gave it, and the worldly estate which it has pleased him to bless me with, I bequeath in the following manner, viz.

 

ITEM 1st. It is my will and desire that during the lifetime of my beloved wife, Rachel Copeland, that the plantation and all things thereon, be kept together and continued as at this time, that the negroes, horses and stock of all kinds, together with all things appertaining to the plantation, be kept together for the support of the family consisting of my beloved wife and daughter, Mary Copeland and my granddaughter, Dolly Copeland.

 

2nd. I will and bequeath to my beloved daughter, Mary Copeland, after the decease of my wife, one hundred acres of the land where I now live, the upper part of said land, whereon the house stands to her and the heirs of her body. But should she die without issue it is my will and desire that the said tract of land belong and turned over to my beloved son Elias Copeland.

I also will and bequeath to my daughter Mary Copeland and to my son, Elias Copeland after the decease of my beloved wife one Negro girl named Nisa and her issue should she have any to be equally divided between them two, viz. Mary and Elias Copeland. I also will and bequeath to my daughter Mary Copeland one negro woman named A-Cena, but should my daughter die without issue my will is that the said negro belong to my heirs. I will and bequeath to my son, Elias Copeland, the remaining part of the land or-tract whereon I now live, after the decease of my wife, to him and his heirs forever.

 

I will and bequeath to my beloved daughter, Sarah Randolph after the decease of my wife, that tract or portion of land joining lands of Alfred Scarborough one hundred acres more or less, known as the Kentuck tract, to her and to her heirs forever.

 

I will and bequeath to Jessie Scarborough five dollars to be paid him by my executors.

 

It is my wi1l and desire that the remaining portion of my estate not already willed away or mentioned above, be sold and equally divided between the remaining children, who I will proceed to name, but before I name my children, it is my will and desire that Dolly Copeland, my granddaughter, receive half a portion with those remaining heirs, the names of whom are ss follows: William Copeland, Ripley Copeland, Martha Huggins, Moses Copeland, Reuben Copeland, Nanny Lewis, Rachel Baker, and the portion of my deceased daughter, Bessie Scarborough I will and desire to go to her children and her heirs forever. The above estated to be divided between those named heirs consists in negroes, horses, stock of all kind, gear, carriages, household furniture, etc. except two beds and furniture one of which I will and bequeath to my daughter Mary Copeland and the other to my granddaughter, Dolly Copeland. Any money or bonds I may die possessed with I will and desire may be divided between my son Elias Copeland and my daughter, Sarah Randolph, should there be any after the payment of my Just debts. Furthermore, I do hereby constitute and appoint William Copeland and Elias Copeland executors of this my last Wil1 and Testament, revoking and annulling all former wills and testaments. In testimony where of I have hereunto affixed my hand and seal this 5th day of May in the year of our Lord one thousand, eight hundred and forty-three and in the sixty seventh year of American Independence.

Personally appeared before me John Mathis who being duly sworn sayeth that he was personally present and saw Ripley Copeland sign, seal, publish and declare the within instrument of writing to be and contain his Last Will and Testment, that he the said Ripley Copeland was at the time of sound and disposing mind, memory and understanding as far as he, this deponent knows and believes, and that Royal Brewer and James McCallum. together with himself, this deponent, did subscribe their names as witnesses thereto at the request of the said Ripley Copeland in his presence and in the presence of each other.
